  • MyBoat, teknenizin konumunu izlemenize ve güvenli alan dışına çıktığında alarm almanıza yardımcı olur.
  • Bir can ve mal güvenliği sistemi değildir. Alarmlar gecikebilir veya ulaşmayabilir; tek önleminiz olarak ona güvenmeyin.
  • Hesabınızı ve şifrenizi kimseyle paylaşmayın; yalnızca yetkili olduğunuz tekneleri izleyin.

1Koşulların kabulü

Bu Kullanım Koşulları (“Koşullar”), MyBoat (“biz”) tarafından sunulan MyBoat uygulamaları, web paneli ve takip cihazından oluşan tekne takip hizmetinin (“Hizmet”) kullanımını düzenler. Hizmete giriş yaparak bu Koşulları ve Gizlilik Politikası’nı kabul etmiş olursunuz. Kabul etmiyorsanız Hizmeti kullanmayın.

2Hizmetin tanımı

Hizmet; teknedeki takip cihazından gelen konumu haritada gösterir, belirlediğiniz güvenli alanı izler, alan dışına çıkış veya cihaz bağlantısının kesilmesi gibi olaylarda bildirim gönderir ve olay geçmişini tutar. Özellikler zaman içinde geliştirilebilir veya değiştirilebilir.

3Hesaplar

  • Hesaplar yönetici tarafından oluşturulur ve size yalnızca yetkili olduğunuz tekneler atanır.
  • Giriş bilgilerinizin gizliliğinden siz sorumlusunuz. Hesabınızı başkalarıyla paylaşmayın.
  • Hesabınızda yetkisiz bir kullanım fark ederseniz derhal hesabınızı oluşturan yönetici üzerinden bize bildirin.
  • Bize verdiğiniz bilgilerin doğru ve güncel olmasını sağlamakla yükümlüsünüz.

4Takip cihazı ve bağlantı

Hizmetin çalışması; takip cihazının doğru kurulmasına, enerjisinin olmasına, GPS sinyali almasına ve internete bağlı kalmasına bağlıdır. Bildirim alabilmek için telefonunuzun internete bağlı olması ve uygulamanın bildirim izninin açık olması gerekir. Cihazın kurulumu, enerjisi ve bağlantısı sizin sorumluluğunuzdadır.

5Önemli güvenlik uyarısı

Hizmet bir can ve mal güvenliği sistemi değildir. Acil durumlarda Sahil Güvenlik (158) veya Acil Çağrı (112) hattını arayın.

Alarmlar; GPS hassasiyeti, cihaz enerjisi, mobil veya Wi-Fi bağlantısı, bildirim sağlayıcıları (Apple, Google), telefonunuzun ayarları (sessiz mod, Odak, pil tasarrufu) ve susturma tercihleri gibi nedenlerle gecikebilir, hatalı olabilir veya hiç ulaşmayabilir. Hizmet; demir nöbetinin, uygun bağlama ve emniyet önlemlerinin, sigortanın, denizcilik mevzuatına uyumun ve acil durum hizmetlerinin yerine geçmez.

6Kabul edilebilir kullanım

Hizmeti kullanırken şunları yapmamayı kabul edersiniz:

  • Sahibinin veya yasal kullanıcısının izni olmadan bir tekneyi ya da kişiyi izlemek.
  • Başkalarının hesaplarına, teknelerine veya verilerine yetkisiz erişmeye çalışmak.
  • Hizmeti, sunucuları veya takip cihazlarını aşırı yüklemek, bozmak ya da güvenlik önlemlerini aşmaya çalışmak.
  • Yazılımı tersine mühendislikle çözmek, kopyalamak veya yasaların izin verdiği durumlar dışında değiştirmek.
  • Hizmeti hukuka aykırı herhangi bir amaçla kullanmak.

7Fikri mülkiyet ve lisans

Hizmet, yazılım, tasarım ve markalar üzerindeki tüm haklar bize veya lisans verenlerimize aittir. Bu Koşullara uymanız şartıyla, Hizmeti kişisel ve ticari olmayan amaçlarla, size ait veya kullanma yetkiniz olan cihazlarda kullanmanız için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz. Teknenize ve hesabınıza ait veriler size aittir.

8Ücretler

Uygulamalar içinde ödeme alınmaz. Takip cihazı veya hizmet için ayrıca bir satış ya da abonelik sözleşmesi yaptıysanız, ücret ve iade koşulları o sözleşmeye tabidir.

9Hizmetin sürekliliği

Hizmeti kesintisiz sunmak için makul çabayı gösteririz; ancak bakım, güncelleme, arıza veya kontrolümüz dışındaki nedenlerle kesintiler olabilir. Hizmetin özelliklerini değiştirebilir, geliştirebilir veya makul bir süre önceden duyurarak sonlandırabiliriz.

10Sorumluluğun sınırlandırılması

Hizmet “olduğu gibi” ve “mevcut olduğu şekilde” sunulur. Yürürlükteki mevzuatın izin verdiği en geniş ölçüde; geciken, hatalı veya ulaşmayan alarmlar, teknenin kaybolması, çalınması veya zarar görmesi ve dolaylı zararlar dahil olmak üzere Hizmetin kullanımından doğan zararlardan sorumlu değiliz. Kast veya ağır ihmalden doğan sorumluluk ile kanunen sınırlanamayan sorumluluklar ve tüketici olarak sahip olduğunuz yasal haklar saklıdır.

11Fesih

Hizmeti dilediğiniz zaman kullanmayı bırakabilir ve hesabınızın silinmesini isteyebilirsiniz. Bu Koşulları ihlal etmeniz halinde hesabınızı askıya alabilir veya kapatabiliriz. Fesih halinde verileriniz Gizlilik Politikası’ndaki sürelere göre silinir.

12Uygulama mağazaları

Uygulamayı Apple App Store’dan indirdiyseniz: Bu Koşullar Apple ile değil, sizinle bizim aramızdadır. Uygulamadan ve içeriğinden Apple değil biz sorumluyuz. Apple’ın uygulamayla ilgili bakım veya destek yükümlülüğü yoktur. Uygulamanın geçerli bir garantiye uymaması halinde Apple’a bildirebilirsiniz; Apple, varsa satın alma bedelini iade eder ve yasaların izin verdiği ölçüde başka bir garanti yükümlülüğü yoktur. Ürün sorumluluğu, mevzuata uygunluk, tüketici koruma ve fikri mülkiyet ihlali iddialarının ele alınmasından Apple değil biz sorumluyuz. Apple ve bağlı ortaklıkları bu Koşulların lehdar üçüncü tarafıdır ve bu Koşulları size karşı uygulama hakkına sahiptir. Uygulamayı kullanırken geçerli üçüncü taraf koşullarına (örneğin kablosuz veri hizmeti sözleşmenize) uymanız gerekir. Google Play üzerinden indirilen uygulamalar için Google Play koşulları da geçerlidir.

13Uygulanacak hukuk

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda genel yetki kuralları uygulanır; tüketici iseniz Tüketici Hakem Heyetlerine ve Tüketici Mahkemelerine başvurma hakkınız saklıdır.

14Değişiklikler ve iletişim

Bu Koşulları güncelleyebiliriz. Güncel sürüm her zaman bu sayfada yayımlanır; önemli değişiklikleri uygulama veya web paneli üzerinden duyururuz. Değişikliklerden sonra Hizmeti kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.

At a glance

  • MyBoat helps you watch your boat’s position and get an alarm when it leaves its safe area.
  • It is not a life-safety or property-protection system. Alarms can be delayed or missed; don’t rely on it as your only precaution.
  • Don’t share your account or password, and only track boats you are authorized to track.

1Acceptance

These Terms of Use (the “Terms”) govern your use of the boat tracking service (the “Service”) provided by MyBoat (“we”, “us”), made up of the MyBoat apps, the web panel and the tracker. By signing in you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2The Service

The Service shows the position reported by the tracker on your boat, watches the safe area you set, sends notifications for events such as leaving the safe area or the tracker losing connection, and keeps an event history. Features may be improved or changed over time.

3Accounts

  • Accounts are created by an administrator, and only boats you are authorized for are assigned to you.
  • You are responsible for keeping your sign-in details confidential. Do not share your account.
  • If you notice unauthorized use of your account, tell us immediately via the administrator who created your account.
  • You must keep the information you give us accurate and up to date.

4Tracker and connectivity

The Service depends on the tracker being installed correctly, powered, receiving a GPS signal and staying connected to the internet. To receive notifications, your phone must be online and notifications must be allowed for the app. Installing, powering and connecting the tracker is your responsibility.

5Important safety notice

The Service is not a life-safety or property-protection system. In an emergency, contact the coast guard or emergency services (in Türkiye: Coast Guard 158, Emergency 112).

Alarms may be delayed, inaccurate or not delivered at all because of GPS accuracy, tracker power, mobile or Wi-Fi connectivity, notification providers (Apple, Google), your phone’s settings (silent mode, Focus, battery saver) and the mute preferences you choose. The Service does not replace anchor watch, proper mooring and safety measures, insurance, compliance with maritime regulations or emergency services.

6Acceptable use

You agree not to:

  • Track any boat or person without the consent of its owner or lawful user.
  • Try to gain unauthorized access to other people’s accounts, boats or data.
  • Overload, disrupt or try to bypass the security of the Service, its servers or trackers.
  • Reverse engineer, copy or modify the software except as permitted by law.
  • Use the Service for any unlawful purpose.

7Intellectual property and license

All rights in the Service, software, design and trademarks belong to us or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes on devices you own or are authorized to use. The data about your boat and account belongs to you.

8Fees

No payments are taken in the apps. If you have a separate sales or subscription agreement for the tracker or the Service, its fees and refund terms are governed by that agreement.

9Availability

We make reasonable efforts to keep the Service running, but interruptions may occur because of maintenance, updates, failures or causes beyond our control. We may change or improve features, or discontinue the Service with reasonable advance notice.

10Limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by applicable law, we are not liable for damages arising from use of the Service, including delayed, inaccurate or undelivered alarms, loss, theft of or damage to a boat, and indirect damages. Nothing in these Terms limits liability for intent or gross negligence, liability that cannot be limited by law, or your statutory rights as a consumer.

11Termination

You may stop using the Service at any time and request deletion of your account. We may suspend or close your account if you breach these Terms. On termination, your data is deleted according to the periods in the Privacy Policy.

12App stores

If you downloaded the app from the Apple App Store: these Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to product liability, legal or regulatory compliance, consumer protection and intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with applicable third-party terms (such as your wireless data service agreement) when using the app. For apps downloaded from Google Play, the Google Play terms also apply.

13Governing law

These Terms are governed by the laws of the Republic of Türkiye. General jurisdiction rules apply to disputes; if you are a consumer, your right to apply to Consumer Arbitration Committees and Consumer Courts, and any mandatory protections of your country of residence, are preserved.

14Changes and contact

We may update these Terms. The current version is always published on this page, and we will announce significant changes in the app or the web panel. Continuing to use the Service after changes means you accept the updated Terms.
